Recently, many countries around the world enacted privacy laws to protect the data of consumers. So far, there are only a handful of states in the U.S. to enact a law to protect the personal information of their residents. <\/p>\n\n\n\n<p>In late 2019, the Florida House of Representatives introduced <a rel=\"noreferrer noopener\" aria-label=\"HB 963 (opens in a new tab)\" href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2020\/963\/BillText\/Filed\/PDF\" target=\"_blank\">HB 963<\/a> with the title \u201cConsumer Data Privacy\u201d to protect the personal information of Florida residents. In early 2020, the Florida Senate introduced a duplicate bill under <a rel=\"noreferrer noopener\" aria-label=\"SB 1670 (opens in a new tab)\" href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2020\/1670\/BillText\/Filed\/PDF\" target=\"_blank\">SB 1670<\/a>.<\/p>\n\n\n\n<p>Florida\u2019s attempt to pass a data privacy law failed. The Florida House \u201cindefinitely postponed\u201d HB 963 and withdrew the bill from consideration. On March 14, 2020, <a rel=\"noreferrer noopener\" href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2020\/963\" target=\"_blank\">HB 963<\/a> died in the Oversight, Transparency, and Public Management Subcommittee. At the same time, the Florida Senate also \u201cindefinitely postponed\u201d SB 1670 and withdrew the bill from consideration. As a result, <a rel=\"noreferrer noopener\" href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2020\/1670\/?Tab=BillHistory\" target=\"_blank\">SB 1670<\/a> died in the Commerce and Tourism Committee. <\/p>\n\n\n\n<p>The proposed Florida law aimed to prohibit \u201cthe use of personal data contained in public records for certain marketing, soliciting, and contact without the person\u2019s consent.\u201d &nbsp;If Florida passed the law, covered operators of a commercial website or online service would have to post a Privacy Notice to explain their data collecting and sharing practices. Additionally, the law would require operators to establish a method to allow consumers to opt-out of having their personal data sold.<\/p>\n\n\n\n<h3>The Proposed Florida law copied Nevada<\/h3>\n\n\n\n<p>Both of the Florida privacy bills seemed to be an incomplete version of the existing <a href=\"https:\/\/www.leg.state.nv.us\/NRS\/NRS-603A.html#NRS603ASec300\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Nevada privacy law<\/a>. The Nevada privacy legislation became law in 2017 and received an update in 2019. Likewise, the Nevada privacy law includes similar definitions of:<\/p>\n\n\n\n<ul><li>A consumer<\/li><li>An operator<\/li><li>Notice requirements<\/li><li>Covered information<\/li><li>A sale of covered information<\/li><li>A designated request address for consumers to send opt-out requests<\/li><li>A verified request for an operator\u2019s response to consumer opt-out requests<\/li><\/ul>\n\n\n\n<p>Unlike the Nevada law, the proposed Florida privacy law would prohibit marketers from using public records to market or solicit the sale of products to an individual. Further, a marketer could not contact the individual without having consent. However, like the Nevada law, the Florida privacy law would not establish a private right of action against an operator. <\/p>\n\n\n\n<p>Florida residents need protection from <a href=\"https:\/\/www.amp.legal\/blog\/data-brokers-individual-opt-out\/\">data brokers<\/a> that exploit the personal information of consumers.
